Terms of service.
These terms govern use of RoadCase. RoadCase is in beta. Read section 05 before relying on it for a live production.
About these terms
The operator is Technically Creative LLC, a Michigan LLC (“we”, “us”). By creating an account or using the service you agree to these terms. If you use RoadCase on behalf of a company, you agree on that company’s behalf and confirm you have authority to do so.
Beta customers may also sign a closed beta agreement. Beta access is provided under that agreement and these terms.
The service
RoadCase records case-level logistics: cases, trucks, scans, manifests, and prints. Your company enrolls its own crew, and crew members sign in to scan cases on and off trucks. We may add, change, or remove features at any time during the beta.
Accounts and sign-in
Sign-in is passwordless, using a passkey or a six-digit code emailed to you. You are responsible for what happens under your account. Keep your device and your email account secure, and do not share codes or passkeys. Tell us promptly at support@roadcase.tools if you believe an account is compromised. Your company’s administrators control crew enrollment and roles for their company.
Your data
Your company owns the logistics data it puts into RoadCase (cases, items, trucks, manifests, photos, scan history). You grant us the rights needed to host, process, back up, and display that data in order to run the service, and for no other purpose. Our handling of personal data is described in the privacy policy.
Scan and audit records are append-only by design. They cannot be edited after the fact, by you or by us. That is the point of the system.
Acceptable use
Do not:
- Attempt to access another company’s data or probe the service’s isolation boundaries.
- Attempt to alter, forge, or replay scan or audit records.
- Reverse engineer, resell, or sublicense the service without written agreement.
- Use the service to break the law, or upload content you have no right to upload.
- Disrupt the service or other users, including load testing without written permission.
Security research on your own company’s data is welcome. Tell us first at support@roadcase.tools.
Beta status, no warranty
The service is provided “as is” and “as available”, with no service level commitment. During the beta:
- There is no uptime guarantee and no support response guarantee.
- Features may change or be withdrawn without notice.
- Data structures may change. We will use reasonable efforts to migrate your data forward, but we do not guarantee it.
- Backups are limited. Database backups are daily on a rolling seven-day window, weekly backups of uploaded files are being put in place, and point-in-time recovery is not enabled. See the retention schedule.
To the maximum extent permitted by law, we disclaim all warranties and conditions, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, error-free, or secure, or that it will meet your requirements.
Some laws give you rights that cannot be excluded, for example consumer guarantees under the Australian Consumer Law. Nothing in these terms excludes rights that cannot lawfully be excluded. Where the law allows us to limit our liability for breach of a non-excludable right, our liability is limited, at our option, to re-supplying the service or paying the cost of re-supply.
Plan your production so that a RoadCase outage is an inconvenience, not a show-stopper. Paper manifests print for a reason.
Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, however caused and under any theory of liability, even if advised of the possibility.
- Our total aggregate liability arising out of or relating to the service is capped at the amounts you paid us for the service in the 12 months before the event giving rise to liability, or USD 100 if you have paid nothing.
These limits do not apply to liability that cannot be limited by law, including liability arising from fraud or from gross negligence or willful misconduct where the applicable law does not permit its exclusion.
The limits in this section apply even if a remedy fails of its essential purpose. They reflect the deal: a beta service, priced accordingly.
Suspension and termination
We may suspend or terminate access:
- Immediately, for breach of section 04, for a security risk, or where required by law.
- Otherwise on 14 days notice.
You may stop using the service at any time, and your company may terminate by notice to support@roadcase.tools.
Data export on exit
For 30 days after termination, we will make your company’s data available for export in a machine-readable format (structured export of cases, items, trucks, scan history, and photos) on request. After that window we may delete or pseudonymize the company’s data, except records we retain as described in the retention schedule.
Changes to these terms
We may update these terms. For material changes we will give at least 14 days notice by email or in the service. Continued use after the notice period is acceptance. If you do not accept, stop using the service before the changes take effect and we will honor section 08.
General
- These terms are governed by the law of the State of Michigan, United States, and the courts of that place have exclusive jurisdiction, except where the law of your place of residence grants you protections and venue that cannot be excluded.
- If a clause is unenforceable, the rest stand.
- These terms plus any signed beta agreement are the whole agreement. If a signed beta agreement conflicts with these terms, the signed agreement wins.
- Neither party is liable for delay or failure caused by events beyond reasonable control.
- You may not assign these terms without our consent. We may assign them to a successor of the business.
